AirPosture Terms of Use

These Terms of Use ("Terms") form a legal agreement between you and Relja Bulajic ("AirPosture," "we," "us," or "our") and govern your access to and use of the AirPosture application, related websites, and related services (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
AirPosture is a posture and wellness application designed to help users monitor posture habits, view analytics, receive reminders, access coaching content, and optionally use connected Apple technologies such as AirPods motion sensors, Apple Health, iCloud, Apple Watch, widgets, Live Activities, notifications, and camera-based posture assessments.
Features may vary by device, operating system, hardware capability, subscription status, account state, region, language, and service availability.
AirPosture is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
2. Eligibility and Acceptable Use
You may use the Service only if you can legally enter into this agreement and comply with applicable law.
You agree that you will not:
- use the Service for any unlawful, fraudulent, abusive, or misleading purpose;
- reverse engineer, decompile, disassemble, or attempt to derive source code from the Service except where prohibited by applicable law from restricting such activity;
- copy, modify, distribute, sell, sublicense, rent, or commercially exploit the Service except as expressly permitted by us;
- interfere with, disrupt, or degrade the integrity, performance, or security of the Service;
- attempt to bypass subscriptions, credits, trials, paywalls, feature limits, safety systems, or technical restrictions;
- use bots, scripts, automation, or scraping systems to access or interact with the Service;
- upload or share content that is unlawful, infringing, harassing, abusive, defamatory, obscene, or otherwise harmful;
- impersonate another person or misrepresent your identity or affiliation;
- use the Service in a way that violates export controls, sanctions laws, or third-party platform rules.
3. Important Health and Safety Disclaimer
The Service provides wellness information, posture scoring, analytics, coaching, reminders, assessments, trends, and AI-generated content for informational and educational purposes only.
You understand and agree that:
- the Service does not provide medical advice, diagnosis, treatment, rehabilitation, or emergency assistance;
- posture scores, assessments, and analytics are estimates based on device signals, calibration, and software models, and may be incomplete, inaccurate, or unsuitable for your circumstances;
- AI-generated insights, narratives, coaching, and recommendations are not produced by licensed healthcare professionals;
- you should consult a qualified physician, physical therapist, or other licensed healthcare professional before acting on posture or wellness guidance, especially if you have pain, injury, a spinal condition, neurological symptoms, or other health concerns;
- if you experience pain, dizziness, numbness, worsening symptoms, or discomfort while using the Service, you should stop using it and seek appropriate medical guidance.
To the maximum extent permitted by law, you use the Service at your own risk.
4. AI Features
The Service may include AI-assisted features such as coaching, summaries, assessments, explanations, messaging, or personalization. These features may rely on third-party AI providers, including cloud AI providers such as OpenAI, and may also use Apple on-device intelligence capabilities where available.
By using AI features, you understand and agree that:
- AI output may be incomplete, inaccurate, generic, delayed, or inappropriate for your situation;
- AI output is not medical, therapeutic, psychological, or legal advice;
- some AI features may be rate-limited, credit-limited, subscription-limited, feature-gated, or changed over time;
- prompts, structured posture summaries, or photos that you choose to submit for AI analysis may be processed by third-party providers to generate results;
- we may change, suspend, or discontinue AI providers, model choices, limits, or AI-related features at any time.
You are responsible for reviewing AI output critically before relying on it.
5. Accounts, Sync, and Device Integrations
Some parts of the Service depend on Apple platform services and permissions, including iCloud, CloudKit, HealthKit, notifications, camera access, motion access, and device-specific hardware support.
You acknowledge that:
- cross-device syncing depends on Apple account services and may be unavailable, delayed, or incomplete;
- some data may remain local to a device while other data may sync through your personal iCloud account;
- disabling permissions or platform services may reduce or disable functionality;
- Apple Watch, Mac, AirPods, iPhone, and other device experiences may differ;
- locking an iPhone may pause some forms of tracking unless a different supported device workflow is in use.
We are not responsible for downtime, sync failures, storage limits, or outages caused by Apple or other third-party platforms.
6. Subscriptions, Trials, Credits, and Billing
AirPosture may offer free and paid features, including auto-renewing subscriptions, trials, credits, quotas, and usage limits.
If you purchase a subscription or in-app purchase through Apple:
- Apple, not AirPosture, processes billing and payment collection;
- subscription pricing, billing period, renewal terms, introductory offers, and taxes are shown in the App Store or in the Service at the time of purchase;
- subscriptions renew automatically unless canceled through your Apple account settings in time for the next renewal period;
- refunds, billing disputes, and purchase management are subject to Apple's terms, billing systems, and applicable law;
- we may change features, limits, or plan structures for future billing periods.
If the Service offers credits, AI usage limits, or other quotas, those may be modified, reset, expire, or be discontinued at our discretion unless otherwise required by law.
7. Photos, User Content, and Social Features
The Service may allow you to create, upload, import, or store content such as profile information, messages, posture photos, assessment images, friend data, challenge participation, and other user-generated content ("User Content").
You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, transmit, display, and use that User Content as reasonably necessary to operate, secure, improve, and provide the Service.
You represent that:
- you own your User Content or have all necessary rights and permissions to provide it;
- you will not upload content that violates privacy rights, publicity rights, intellectual property rights, or applicable law;
- if you submit a photo of another person, you have that person's permission or another valid legal basis to do so.
We may remove User Content or restrict access to features if we reasonably believe content or conduct violates these Terms, platform rules, or applicable law.
8. HealthKit and Wellness Data
If you choose to connect Apple Health, AirPosture may read or write certain wellness-related data as permitted by you and Apple platform rules. Health data is handled in accordance with Apple's HealthKit requirements and our Privacy Policy.
We do not sell HealthKit data, and we do not use HealthKit data for advertising.

10. Intellectual Property
The Service, including its software, models, interfaces, design, branding, text, graphics, compilations, audiovisual materials, data selection, and related intellectual property rights, is owned by us or our licensors and is protected by applicable law.
Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own personal, non-commercial use in accordance with these Terms and applicable platform rules.
11. Third-Party Services
The Service may rely on or integrate with third-party services, platforms, or providers, including Apple, OpenAI, analytics providers, hosting providers, and other infrastructure or AI vendors.
Third-party services may be governed by their own terms, privacy policies, and technical limitations. We are not responsible for third-party acts, omissions, outages, policies, or data handling practices except as required by law.
12. Updates, Availability, and Changes
We may update, modify, suspend, or discontinue any part of the Service at any time, including features, integrations, limits, interfaces, subscription offerings, eligibility rules, or supported devices.
We may also update these Terms from time to time. If we make material changes, we may provide notice by updating the date above, through the Service, or by other reasonable means. Your continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, quiet enjoyment, and error-free operation.
We do not warrant that:
- the Service will always be available, uninterrupted, secure, or error-free;
- posture scores, assessments, AI output, analytics, trends, or notifications will be accurate or suitable for your needs;
- defects will always be corrected;
- the Service will be compatible with every device, accessory, region, or operating system version.
14. Limitation of Liability
To the maximum extent permitted by law, AirPosture, Relja Bulajic, and our affiliates, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, device access, or use, arising out of or related to the Service.
Without limiting the foregoing, we are not liable for:
- injury, discomfort, or health outcomes related to posture tracking, reminders, exercises, insights, or AI output;
- data loss, corrupted data, sync issues, or service interruptions;
- delays, outages, or failures caused by Apple, cloud providers, AI providers, network operators, or device manufacturers;
- unauthorized access to your account or content caused by your failure to secure your device, Apple account, or credentials.
To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to the Service will not exceed the greater of:
- the total amount you paid to us through the Service in the 12 months before the event giving rise to the claim; or
- USD $50.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Relja Bulajic and our affiliates, licensors, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your User Content;
- your misuse of the Service;
- your violation of these Terms;
- your violation of applicable law or third-party rights.
16. Termination
We may suspend or terminate your access to all or part of the Service if we reasonably believe you have violated these Terms, created risk or potential legal exposure, engaged in abuse, or used the Service in a way that may harm us, other users, or third parties.
You may stop using the Service at any time. Upon termination, the rights granted to you under these Terms end immediately, but provisions that by their nature should survive termination will survive, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and general legal terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws in your jurisdiction require otherwise.
You and AirPosture agree that courts located in Belgrade, Serbia will have non-exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where applicable law gives you the right to bring a claim in another forum.
18. General Terms
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision.
These Terms, together with the Privacy Policy and any additional terms presented to you for specific features, form the entire agreement between you and us regarding the Service and supersede prior agreements relating to the same subject matter.
